Please read these Terms carefully before booking. They set out how bookings are confirmed, what your tour price does and does not include, our cancellation and refund scale, and where responsibility sits between you, Travel All Season and our Suppliers. Introduction
These Terms and Conditions govern the use of the www.travelallseason.co.in website, its sub-domains and any associated application, and all tours, travel arrangements and related services offered or performed by Travel All Season (“we”, “us”, “our”).
By browsing our website, submitting an enquiry, or making a booking with us, you confirm that you have read, understood and accepted these Terms and Conditions, together with our Privacy Policy. If you do not accept them, please do not use our services.
Where a booking is made on behalf of other travellers, the person making the booking (the “lead traveller”) confirms that they are authorised to accept these Terms on behalf of every person named in the booking, and that all details supplied are accurate.
Definitions
- “Travel All Season” means Travel All Season, together with its successors, subsidiaries, divisions and groups in India.
- “User” or “Traveller” means any person who browses our website, submits an enquiry, or books a tour or service with us.
- “Supplier” means any third party that delivers a component of your trip — including airlines, hotels, resorts, transport operators, local tour operators, guides and activity providers.
- “Booking” means a confirmed reservation for a tour, package or service, made once we have issued a written confirmation and received the required advance payment.
- “Services” means the tours, packages, itineraries, bookings and related travel arrangements offered or performed by Travel All Season.
Our role
Travel All Season acts as a tour organiser and as an agent in arranging travel services delivered by independent Suppliers. While we select our Suppliers with care and coordinate your itinerary, the transport, accommodation and activities themselves are provided by those Suppliers and are subject to their own terms, conditions and limitations of liability.
We are not the owner or operator of the aircraft, vehicles, hotels or venues used in your trip, and we do not control their day-to-day operation.
Bookings and confirmation
Enquiries may be made through our website, by e-mail, by telephone or through WhatsApp. An enquiry is not a booking.
A booking becomes confirmed only when both of the following have occurred:
- we have issued a written booking confirmation (by e-mail or WhatsApp) setting out the itinerary and price; and
- the required advance payment has been received by us.
All bookings are subject to availability at the time of confirmation. Prices, availability and inclusions quoted before confirmation are indicative and may change. We recommend booking at least 2–4 weeks in advance for domestic tours and 4–8 weeks for international or complex trips, particularly during peak season.
It is your responsibility to check the booking confirmation carefully as soon as you receive it and to inform us immediately of any error. We cannot accept liability for costs arising from incorrect details that were not brought to our attention in good time.
Prices and payment
Prices
All tour prices quoted on our website and in our confirmations are in Indian Rupees (INR) and are inclusive of applicable GST unless expressly stated otherwise. There are no hidden charges.
Prices are based on costs, exchange rates and taxes prevailing at the time of quotation. Where a significant change occurs in fuel costs, government taxes, statutory levies or Supplier tariffs after your booking is confirmed, we reserve the right to pass on the difference. Any such increase will be notified to you with a written explanation, and you may cancel without penalty if the increase exceeds 10% of the tour price.
Group pricing is available for parties of eight travellers or more. Please contact us to discuss group rates.
Payment
We accept bank transfers, UPI, and major credit and debit cards. A partial advance payment is required at the time of booking, with the balance payable before departure as set out in your booking confirmation.
If the balance is not received by the due date, we reserve the right to treat the booking as cancelled by you and to apply the cancellation charges set out below.
Payments are processed by third-party payment gateways. Travel All Season does not store your full card number, CVV or net-banking credentials. Bank charges, gateway fees or currency conversion charges levied by your bank are your responsibility.
Inclusions and exclusions
What is included in your tour price is stated in the itinerary supplied with your booking confirmation. That itinerary prevails over any general description on the website.
Unless expressly stated otherwise, the following are not included:
- airfares, visa fees and passport charges, unless listed as an inclusion;
- travel insurance;
- meals, drinks and snacks not specified in the itinerary;
- personal expenses such as laundry, telephone calls, tips and gratuities;
- optional activities, entrance fees and excursions not listed in the itinerary;
- medical, evacuation and emergency costs;
- any cost arising from a delay, diversion, cancellation or other event outside our reasonable control.
Cancellation and refunds
Cancellation by you
Cancellations must be notified to us in writing (e-mail or WhatsApp). The date on which we receive your written notice is the date used to calculate charges. The following scale applies:
- 30 or more days before departure — full refund, less booking fees.
- 15 to 29 days before departure — 50% refund.
- Within 14 days of departure — no refund.
Certain components of a trip — notably airfares, visa fees, and some hotel and cruise reservations — may be non-refundable from the moment they are booked, irrespective of the scale above. Where this applies, it will be stated in your booking confirmation.
Approved refunds are processed to the original method of payment, ordinarily within 7 to 14 working days of approval. The time taken for the amount to reach your account depends on your bank or card issuer.
Cancellation by us
In the rare event that we need to cancel a tour, you will receive a full refund or the option to reschedule at no additional cost. We will notify you at the earliest possible opportunity. We may cancel a departure where the minimum number of travellers is not reached, or where cancellation is necessary for reasons of safety or force majeure.
Our liability in the event of a cancellation by us is limited to a refund of amounts paid to us, or an alternative arrangement of equivalent value where you accept one. We are not liable for incidental costs such as non-refundable flights booked independently, visa fees or loss of leave.
Amendments
Requests to amend a confirmed booking (dates, destinations or traveller names) are subject to availability and to any charges levied by our Suppliers. We will always tell you the cost of an amendment before it is made.
Itinerary changes
Travel is unpredictable. Weather, road and trail conditions, local restrictions, strikes, political events, flight schedule changes, and the availability of accommodation or guides may require us to alter an itinerary before or during a trip.
Where a change is necessary, we will make reasonable efforts to provide an alternative of comparable standard. Minor changes to an itinerary do not entitle you to a refund. Where a major change is made before departure, you may accept the change, accept an alternative tour of equivalent value, or cancel and receive a refund of amounts paid to us.
Any unused portion of a tour — for example, a missed excursion or an unused hotel night — is not refundable.
Traveller responsibilities
You are responsible for:
- Documentation — holding a valid passport, visas, permits and any other document required for your journey, with sufficient validity. We may offer guidance, but the responsibility is yours, and we accept no liability where travel is denied for want of correct documentation.
- Health and fitness — ensuring that you are medically fit for the tour booked, obtaining required vaccinations, and informing us in writing before booking of any medical condition, disability, dietary requirement or accessibility need that may affect your trip or that of others.
- Punctuality — arriving on time for departures, transfers and activities. We are not liable for any cost or loss caused by your late arrival.
- Conduct — behaving in a manner that does not put others at risk, cause offence or damage property, and complying with the instructions of guides, drivers and local authorities.
- Personal belongings — the care and security of your own baggage, documents and valuables throughout the trip.
We reserve the right to remove any traveller from a tour, without refund, whose conduct is in our reasonable opinion dangerous, unlawful, or seriously disruptive to other travellers or to our Suppliers. Any resulting costs, including onward travel, are the traveller’s responsibility.
Travel insurance
Comprehensive travel insurance is strongly recommended for every traveller, and may be mandatory for certain international or adventure tours.
Your policy should cover, at minimum: medical treatment and hospitalisation abroad, emergency evacuation and repatriation, trip cancellation and curtailment, and loss of or damage to baggage and personal documents. If you undertake adventure activities such as trekking at altitude, rafting or skiing, ensure your policy covers them expressly.
Travellers who choose not to obtain insurance do so at their own risk and accept responsibility for any loss that insurance would otherwise have covered.
Limitation of liability
Travel All Season accepts liability for the negligent acts or omissions of its own employees acting within the scope of their employment.
We do not accept liability for:
- the acts, omissions, default or insolvency of any independent Supplier, or of any person not employed by us;
- loss, damage, injury, illness or death arising from a cause outside our reasonable control;
- indirect or consequential loss of any kind, including loss of enjoyment, loss of income, or loss of opportunity;
- loss of or damage to baggage, documents or personal valuables;
- any activity or excursion that you arrange independently, whether or not a member of our staff assisted you in arranging it.
Where we are found liable, our total liability to you is limited to the amount you have paid to us in respect of the booking concerned, save where such limitation is not permitted by law. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, or for fraud, where such exclusion is prohibited by applicable law.
Where an international convention (such as the Warsaw or Montreal Convention for carriage by air) applies to a component of your trip, our liability in respect of that component is limited as provided by that convention.
Force majeure
We are not liable for any failure or delay in performing our obligations where that failure or delay results from an event beyond our reasonable control. Such events include, but are not limited to: war, threat of war, civil unrest, terrorist activity, riot, strike or industrial dispute, government action, border closure, epidemic or pandemic, quarantine, natural disaster, earthquake, landslide, flood, adverse weather, fire, and the disruption or cancellation of transport services.
Where a force majeure event prevents a tour from proceeding, we will make reasonable efforts to recover what we can from our Suppliers and pass it on to you, but we are not obliged to refund amounts that our Suppliers do not refund to us.
Use of the website
The content of this website — including text, images, photographs, itineraries, logos, graphics and page design — is the property of Travel All Season or is used under licence, and is protected by copyright and other intellectual property laws.
You may view, download and print content from this website for your own personal, non-commercial use in planning a trip with us. You may not otherwise copy, reproduce, republish, distribute, modify or exploit any part of it without our prior written consent.
You agree not to use the website to transmit unlawful, defamatory or misleading content, to interfere with its operation or security, to make speculative or fraudulent bookings, or to extract data by automated means.
While we take care to keep the information on this website accurate and current, tour details, pricing and availability may change, and errors may occasionally occur. The details set out in your written booking confirmation prevail over anything published on the website.
Third-party links and advertising
Our website contains links to third-party websites and may display advertising served by third parties. We do not control such websites or advertisements, do not endorse their content, and accept no responsibility for them. Any dealings you have with a third party through our website are between you and that third party.
Privacy
Personal data supplied to us in connection with an enquiry or a booking is handled in accordance with our Privacy Policy, which forms part of these Terms and Conditions. To deliver a booking, your details will be shared with the Suppliers who deliver the components of your trip, and where required with government and immigration authorities.
Complaints
If a problem arises during your trip, please raise it immediately with your guide, driver or local representative, and with our office. Most problems can be resolved on the spot. A complaint reported only after the tour has ended is far harder for us or our Suppliers to remedy.
If the matter is not resolved to your satisfaction, please write to us at info@travelallseason.co.in within 30 days of the end of your trip, setting out the details. We will acknowledge your complaint and aim to respond substantively within 30 days.
Governing law and jurisdiction
These Terms and Conditions, and any contract formed between you and Travel All Season, are governed by the laws of India. The courts of Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with them.
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force.
Changes to these Terms
We may revise these Terms and Conditions from time to time. The version published on this page at the date of your booking is the version that applies to that booking. Continued use of our website after a revision constitutes acceptance of the revised Terms.
